day of January then next ensuing the date of the said note for value received
and by means thereof and by force of the statute in that case lately made and
provided the said John Baker became chargeable to pay to the said Duncan
the af.d sum of money according to the date of the said note and so being thereof
chargeable in Consideration thereof afterwards to witt on the ^said thirtieth^ day of Steptember
Anno Dom MDCCXXXV at the County af.d upon himself did assume and
and to the said Duncan then and there faithfully promise to pay the said
sum of money according to the tenor of the said note  Nevertheless the said John
his promise and assumption aforesaid in form aforesaid made nothing regarding but minding
and fraudulently intending intending the said Duncan in that part Craftily and subtilly
to Deceive and defraud the af.d sum of Money according to the tenor of the said note hath
not paid or him for the same in any sort Contented but the same to ^him to^ pay hitherto hath refused
and still doth refuse altho thereto afterwards to wit on the Eighth day of January Ann Dom
MDCCXXXV at the County aforesaid and often since that time by the said Duncan required
where upon the said Duncan says he is the worse Twenty pounds Current money of Maryland
and thereof he brings suit &a                        Pledges &a  John Doe R Roe

    And the aforesaid John Baker by his attorney afd Comes and defends the force
and Injury when &a and prays Leave thereof to Imparle here untill the Next
Court to be held at dividing Creek the third Tuesday of August ann Dom One thousand
seven hundred and thirty Seven and he hath it and the same day is given to
the afd Duncan here also &a

    Att which day here Came againe as well the afd Duncan Murray as the afd John
Baker by their attorneys afd and whereupon the same John Prays further Leave thereof
to Imparle here untill the next Court to be held at the dividing Creek the third Tuesday
of November Ann Dom One thousand Seven hundred and thirty Seven and he hath
it and the Same day is given to the afd Duncan here also &a

Att which day here Came again as well the aforesaid Duncan Murray as the aforesaid
John Baker by their attorneys af.d and whereupon the same John Prays further Leave
thereof to Imparle hereuntill the Next Court to be held at the dividing Creek the third Tuesday
of March Ann Dom one thousand seven hundred and thirty seven and he hath it and the same
day is given to the aforesaid Duncan here also &a
