And Whereupon the said Joseph by Charles Goldsborough his attorney saith that
whereas the af.d Alexander the thirteenth day of August seventeen hundred thirty and four
at Somerset County af.d by his certain writing obligatory had granted himself to be
held and firmly bound unto the af.d Joseph in the sum of ninety one pounds one
shilling and six pence af.d to be paid unto the af.d Joseph when thereof afterwards
he should be required  Nevertheless the af.d Alexander altho' often required the afd
sum of money unto the af.d Joseph hath not rendred but that unto the afd him hetherto
to render altogether hath refused still doth refuse to the damage of the same
Joseph ten pounds and one thousand pounds of tobacco and therefore he brings
suit &a and doth bring here into Court the writing obligatory af.d with the debt
af.d in form af.d doth testify the date whereof is the same day and year aforesaid
                                                                                    Pledges &a  J Doe & R Roe

And the af.d Alexander Fullerton by William Goldsborough his attorney Comes
and defends the force and Injury when &a and saith that he Cannot deny the action
af.d of the af.d Joseph Ennalls nor but that the writing obligatory af.d is the
deed of the same Alexander Fullerton nor but that he oweth the same Joseph
Ennalls the af.d ninety one pounds one shilling and six pence in manner and
form as the af.d Joseph Ennall above against him declared

Therefore it is Considered the af.d Joseph Ennalls recover against the af.d
Alexander Fullerton his debt af.d and his damages by occasion of the detention
of the same debt to
257               pounds of tobacco to the same Joseph of his assent by the Court
here adjudged and the af.d Alexander Fullerton in mercy &a
