tobacco and Cask which unto him he oweth and unjustly detaineth &a And Whereupon the same John Kenny by William Goldsborough his attorney saith that whereas the af.d John Wetherby the twenty second day of august Anno Dom seventeen hundred thirty and four at Somerset County af.d by his certain writing obligatory had granted himself to be bound unto the af.d John Kenny in the af.d sum of eighteen ^thousand^ pounds of good sound Merchantable tobacco and Cask to be paid unto the af.d John Kenny when thereof afterward he should be required Nevertheless the af.d John Wetherby altho' often required the af.d sum of eighteen pounds of good sound merchantable tobacco and Cask unto the af.d John Kenny yet hath not paid but that unto him hitherto to pay altogether hath refused and still doth refuse to the damage of the same John Kenny twenty thousand pounds of like tobacco and Cask and therefore he brings this suit &a and brings here into Court the writing obligatary af.d which the debt af.d in form af.d testified the date whereof is the same day and year af.d &a pledges &a J Doe & R Roe And the af.d John Wetherby by Charles Goldsborough his attorney Cometh and defendeth the force and Injury when &a and saith that he Cannot deny the action af.d of the af.d John Kenny nor but that the writing obligatory af.d is the deed of the same John Wetherby nor but that he oweth the same John Kenny the af.d eighteen thousand pounds of good sound Merchantable tobacco and Cask in manner and form as the af.d John Kenny above against him declared Therefore it is Considered that the af.d John Kenny recover against the af.d John Wetherby his debt af.d and his damages by occasion of the detention of the same debt to pounds of tobacco to the same John ^Kenny^ of his assent by the Court here adjudged and the af.d John Wetherby in mercy &a |
