1737 221 in the plea af.d in form following Somerset ss.t Charles Ramsey late of Somerset County planter was attached to answer unto Richard Brooks of a plea of trespass upon the Case &.a And Whereupon the same Richard by Robert Jenckins Henry his attorney complains that whereas the said Charles after the first day of may Anno Dom one thousand seven hundred and five (to witt) the tenth day of August in the year of our Lord God one thousand seven hundred and thirty seven at Somerset County af.d made his Certain note in writing Called a promissary note with his own proper hand thereunto subscribed bearing date the same day and year last above mentioned and the same note to the af.d Richard then and there did deliver and by the same note did promise to pay to the af.d Richard Brooks the sum of five pounds and ten shillings Currt money of maryland to be paid with Interest upon demand for value Received by reason of which said premisses and also by force of the statute in such case thereof Lately made and provided the same Charles became chargeable to pay to the same Richard the af.d sum of five pounds ten shillings with Interest according to the tenor of the note af.d and the af.d Charles so thereof Chargeable being afterwards (to witt) the same day and year last above mentioned at the County af.d upon himself did assume and to the same Richard then and there faithfully promise that he the af.d Charles the af.d five pounds ten shillings with Interest thereon upon demand to him the said Richard he would well and truely faithfully pay and Content and the said Richard in fact saith that the Interest of the same five pounds tenn shillings af.d amounts to the sum of three shillings and eleven pence of which the said Charles afterwards by the same Richard had notice Nevertheless the said Charles his promise and assumption and assumption af.d (in form af.d made nothing regarding but minding and fraudulently intending the same Richard in that part Craftily and Subtilly to deceive and defraud the af.d sum of five pounds ten shillings and three shillings and eleven pence Interest as af.d which in the whole amount to five pounds thirteen shillings and eleven pence or any penny thereof to the said Richard hath not as yett paid or him for the same in any sort Contented altho' the same to do the said Charles afterwards (to witt) the same day and year last above mentioned at the County af.d and often afterwards by the said Richard was thereunto |
