220 fourteen pounds fourteen shillings and three pence sterling to the said James Waughop or order according to the tenor of the Indorsement af.d and thereupon the said James Breemin afterwards to witt the same day and year last mentioned at the place af.d in Consideration of the premisses upon himself did assume and to the said James Waughop then and there faitfhfully did promise that he the same James Waughop then and there faithfully did promise that he the said James Bremin the af.d three pounds four shillings sterling with all Lawfull damages Costs and Interists by the said James Waughop suffered and sustained and by occasion of the non axceptance ^and non payment^ of the said first bill of exchange as to the af.d three pound four shillings residue of the af.d fourteen pounds fourteen shillings and three pence in the af.d bill specifyed when he should be afterwards thereunto requested unto the same James Waughop would well and truely pay and Content and the af.d James Waughop in fact saith that the Lawfull Costs damages and intrests of him the same James Waughop occasoned by the non exceptance and non payment of the three pounds four shillings residue as af.d ammount to the same of thirteen shillings and ten pence sterling whereof the said James Bremin the day year and place last mentioned had Nottice nevertheless the said James Bremin his promise and assumption af.d nothing regarding but minding and fraudulently intending the said James Waghop in this part Craftily and Subjectly to deceive and defraud the af.d three pounds and four shillings ^sterling^ together with all Lawfull Costs and damages and Interests af.d which ^in the whole^ amount unto the sum of three pounds seventeen shillings and ten pence sterling or any peny thereof to the af.d James Waughop hath not paid altho to do the same the af.d James Bremin to witt the same day and year last mentioned and often afterwards at Somerst County af.d by the af.d James Waughop was required but that to him heitherto to pay all together hath refused and denyed and still doth refuse and deny to the damage of him the said James Waughop eleven pounds sterling and thereupon he brings suit &.a Pledges &a J: Doe & R Roe And the afd James Bremin in his proper person Comes and defends the force and Injury when &a and Saith that he Cannot deny the action afd of the aforesaid James Waughop nor but that he did assume upon himselfe in manner and form as the aforesaid James Waughop above against him hath Complained and as to the damage of the same James |
