220 the same Charles Rogers then and there was required to accept the said first bill of exchange according to the use and Custom of Merchants from all the time af.d used and approved and the said Charles Rogers the same first bill of exchange so as af.d Indorsed did then and there agreeable to the use and Custom of merchants as aforesaid used and approved accept for eleven pounds ten shillings and three pence sterling part of the fourteen pounds fourteen shilling and three pence sterling in the said bill in the said bill Contained and the same unto him the same James Waughop did pay and Satisfie but as to three pounds and four shillings sterling part of the said fourteen pounds fourteen shillings and three pence sterling in the said bill Contained residue the same Charles Rogers to accept and according to the Use and Custom of merchants from all the time af.d used and approved make payment of unto the af.d James Waughop according to the form and effect of the said first bill of exchange and Indorsement af.d the af.d Charles Rogers then and there did refuse and the af.d three pounds and four shillings sterling of the said fourteen pounds fourteen shillings and three pence sterling residue as af.d in the said first bill of exchange specifyed according to the forme of the said first bill of exchange and the Indorsment thereon to him the same James Waughop hath not paid by reason whereof the said first bill of exchange for want of due acceptance and for non payment of the said three pounds four shillings sterling the same first bill of exchange then and there according to the use and Custom of merchants in that part from all the time af.d used and approved In due forme of writing was protested and afterwards to witt the same day and year last mentioned at Somerset County af.d he the said James Breemin of the premisses had nottice and the said James Bremin by reason of his Indorcement af.d and by pretext of the premisses had nottice according to the use and Custom of merchants from the whole time af.d as before used and approved became and was chargeable to pay the af.d James Waughop the af.d three pounds four shillings residue of the said fourteen pounds fourteen shillings and three pence sterling in the said first bill ^of exchange^ Contained with all the lawfull Costs damages and Interest by the said James Waughom suffered and sustained for want of due acceptance and payment of the said three pounds four shillings sterling residue of the said fourteen |
