219 the af.d James Waughop declared against the af.d James Breman in the plea af.d in form following Somerset County sst James Bremin late of Somerset County planter was attached to answer unto John Waughop of a plea of trespass upon the Case &.a And Whereupon the Same James Waughop by Robert Jenckins Henry his attorney complains that whereas a Certain Thomas Lambden the nineteenth day of November in the year of our Lord God one thousand seven hundred and thirty five at Somerset County af.d the same Thomas Lambden then and there negotiateing and Comerce useing according to the use and Custom of Merchants from the time whereof the memory of man is not to the Contrary in such case used and ^ap^proved did make and draw his certain first bill of exchange in wrighting bearing date the same day and year and the same first bill of exchange ^with^ his proper name and hand then and there did subscribe and and that bill to a Certain M.r Charles Rogers merchant in London then and yett negotiateing and Comerce useing to witt at London in Somerset County af.d did direct and by the same bill of exchange did require the same Charles Rogers at thirty days sight of that his first bill of exchange his second nor third bills of exchange of the same tenor and date paid to pay unto the af.d James Bremin by the name of M.r James Bremin (the same James Bremin then and there negotiating and Comerce useing to witt at Somerset af.d or his order) the sum of fourteen pounds fourteen shillings and three pence sterling for value Received to make good payment and place the same to the accompt of him the same Thomas and whereas also afterwards to witt the same month of november Anno Dom one thousand seven hundred and thirty five at Somerset County af.d the af.d James Bremin (the af.d sum of fourteen pounds fourteen shillings and three pence sterling in the said bill of exchange mentioned not paid being) by his certain Indorsement with the proper hand of the said James Bremin upon the same bill of exchange subscribed did order the said money in same bill of exchange mentioned to be paid to the said James Waughop or his orders for value Received according to the tenor of the said bill of exchange and the Custom of merchants used and approved as af.d and afterwards to witt the sixth day of december in the year of our Lord God one thousand seven hundred thirty and six at London af.d in Somerset County af.d the af.d the af.d first bill of exchange unto the af.d Charles Rogers was known and the |
