21 Sturges Charles Townsend Joseph Houston Robert Mitchell Richard Chambers William Mumford Moses Driskill George Benston John Shiles John Peden James Jones who to say the truth of the premisses afd being duely Elected tryed & Sworn and after that the ^same^ Jurors of their Verdict thereof to Say by the Court were Charged and from the barr of this Court of their Verdict of and upon the premisses to render between them selves to Command did recede and thereof amongst themselves being fully agreed and afterwards to the Same Barr or their Verdict in that part to render returned but the afd Thomas Fletcher & Sarah his wife altho Solemnly Called Came not nor in their Writt & declaration afd against the afd Abraham Mannering & Sarah his wife further prosecuted Therefore it is Considered that the afd Thomas Fletcher and Sarah his wife and their Pledges of Prosecuting to witt John Doe & Richard Roe be in mercy and that the afd Abraham Mannering and Comfort his wife goe thereof without day &c and also it is Considered that the aforesaid Abraham Mannering and Comfort recover against the afd Thomas Fletcher & Sarah his wife pounds 755 of tobacco for their Costs and Charges by them about their defence in that part Sustained to the same Abraham and Comfort by the Court here of their assent according to the form of the Statute in such Case Lately made and provided adjudged and that the afd Abraham Mannering and Comfort his wife have thereof their Execution &c
the said Alex.d in his life time to witt the first day of may Anno Dom seventeen hundred and thirty four at the County of Somerset af.d within the Jurisdiction of this Court was indebted unto the said John in seven pounds sixteen shillings and six pence curr.t money of Maryland for sundrys properly chargeable in Account as by Account thereof hereunto annexed may in Court appear and being so thereof Indebted the said Alex.d his life time to witt the day and year af.d at the place af.d in Consideration thereof upon himself did assume and to the said John then and there did faithfully promise that he the said Alex.d the said seven pounds sixteen shillings and six pence to the said John when he should be thereunto requested he would well and faithfully pay and Content and altho the said Alex.d in his life time three pounds eighteen shillings and six pence pcell of the af.d seven pounds sixteen shillings and six pence to the said John he hath paid and Satisfied Yett as to three pounds eighteen shillings Residue of the af.d seven pounds sixteen shillings and six pence the said Alex.d in his life time nor the af.d Ann since the decease of the said Alex.d the promise and assumption of the said Alexander in form af.d made nothing regarding |
