216 the parties day is given to the parties aforesaid here before his Lordships Justices at dividing Creek untill the third Tuesday of August then next following in the Same State as at present saving to the parties &a Att which day here before his Lordships Justices at dividing Creek Came as well the afd Peter Taylor as the afd John Evans by their attorneys afd and hereupon the said Peter Taylor declared against the afd John Evans in the plea afd in form following Somerset County ss John Evans Late of Somerset County planter was attached to answer unto Peter Taylor of a plea of trespass upon the Case &a And whereupon the same Peter by Charles Goldsborough his attorney complaineth that whereas he the same Peter is a quiet peaceable honnest and in offensive subiect of our Lord the King that now is and as a good true quiet peaceably honest and Inoffensive subject of the same Lord the King and of divers of his progenitors late Kings and Queens of England from the time of his nativity hitherto himself hath be haved and Governed and of good name Credit fame and behaviour among all his neighbours and other Subjects of our said Lord the King was held and reputed and from the staines and Charges of trespass or any other hurt full or Malicious Crime thro' the time of his whole life past free and Clear hath remained and Continued by means whereof the same Peter the favour good will and esteem of his neighbours and other Subjects of the ^said^ Lord the King to whom the said Peter was known got and obtained and whereas he the said Peter never did with force and arms unlawfully take a dark bay coloured Gelding being the proper goods and Chattles of a Certain John Evans and the same Gelding Imprison and disfigure nor the hair from the tail of the said Gelding unlawfully Cutt Nevertheless the af.d John Evans knowing the premisses af.d to be true yet minding and maliciously Intending the same Peter in this part to vex and Injure and the good name and Credit of the same Peter to destroy and also to cause the same Peter great sums of money and tobacco to expend without any probable Just or reasonable Cause at a Court of the right Honourable Charles absolute Lord and proprietary of the provinces of maryland and avalon Lord Baron of Baltemore &.a held for Somerset County at deviding Creek in the County af.d in the Court house the twenty first day of december Anno Dom seventeen hundred thirty and six before the Honourable Levin Gale Esq.r Coll Robert King M.r William Stoughton and Coll George Dashiell then the said Lord proprietary his Justices of the same Court assigned as well to hear and determine all felonys trespasses and other malefeasances in the said County perpetrated ^as^ the Goal in the same County to deliver a Certain bill of Indictment against the af.d Peter falsely and maliciously and without any reasonable or probable |
