probable Cause did cause and procure to be witt writt containing this false matter
following to witt that he the said Peter by the name of Peter Taylor late of Somerset
County planter the twenty first day of December in the year of our Lord God one
thousand seven hundred and thirty six at the Court house at deviding Creek in the
County af.d  one dark bay Colered Gelding being the proper goods and Chattles of the said
John Evans with force and arms unlawfully did take and Imprison and the same
Gelding so as af.d Imprisoned being with force and arms did disfigure and from the
tail of the same Gelding then and there the hair thereof did with force and arms unlawfully
Cutt off to the great damage of the said John Evans and against the peace of the said Right
Honourable the Lord proprietary that now is his good Rule and Goverment which same
bill so as af.d writ containing the false matter af.d the af.d John Evans at the af.d Court
of Goal Delivery held for Somerset County af.d in the said County the said twenty first
day of december Anno Dom seventeen hundred thirty and six af.d before the Justices af.d
did exhibit and to the Jurors then and there being Impannelled and Sworne to enquire
for the said Lord proprietary and the body of the County af.d as a true bill of Indictment
falsely and Maliciously did cause to be delivered and with an Intent that the said
false Matter in the said bill contained should by the Jurors af.d be found to be true
the said John Evans then and there falsely maliciously and vexatiously did cause and
procure divers evidences against the said Peter upon their Corporall ^Oath^ to them by the
Justices af.d duely administred to the Jurors af.d to be sworn (the same Justices then
and there having full power the oaths power the oaths af.d to the same evidences
to administer (Whereupon the same Jurors so as af.d charged and sworn to enquire
for the said Lord proprietary and the body of the County af.d well knowing & perceiving
the whole matter in the same bill Contained was false and by the same John Evans
without any probable Cause falsely and Maliciously against the said Peter
devised and that no such offence ever was Comitted by the af.d Peter then and there
sayed upon their oath af.d before the same Justices that they of the matter in the
same bill of Indictment contained were altogether Ignorant by pretext of which
premisses the same Peter is greatly vxed vexed and Injured and into infamy and
Contempt is brought and also great sums of money and tobacco in and about the
Manifestation of his Innocency and defence of himself in the premisses to expand was
obliged and Compelled to the damage of the said Peter Taylor seven thousand pounds
