Maryland ss.t Charles absolute Lord and propry of the provinces of maryland and avalon Lord Baron of Baltemore &a To the Justices and Clerk of Somerset County Greeting we being willing for certain Causes to be Certifyed of the Record and proceedings of a Certain action before you depending between Peter Taylor Junr and John Evans of a plea of trespass upon the case We Command you that the Record and proceedings in the action af.d with all things thereunto relating as far as before you it remains by whatsoever name the parties in the same are distinguished to our Justices of our Provincial Court to be held at Annapolis the third tuesday of may next under your hands and seals you send together with this writ that our same Justices may further do therein that which of right they see ought to be done Wittness Levin Gale Esq.r Chief Justice of our provincial Court the 28.th day of October in the 23.d year of our Domn &c Annoq Dom 1737 Issd Febry 27 1737 (Will Beckingham) Wm Ghiselin Clk March 2.d 1737 Allowed p Levin Gale Which Same writt and the Record and Proceedings in the Same Writt mentioned with all that happened before us we send in these words following Command was Given to the Sheriffe of Somerset County that he Should take John Evans Late of Somerset County planter if he should be found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at deviding Creek in the same County the third tuesday of June Anno Dom one thousand seven hundred and thirty seven to answer unto Peter Taylor of a plea of trespass upon the Case &a Att which day here Came before his Lordships Justices at ^a^ Court then held at deviding Creek in the County af.d came the af.d Peter Taylor by Charles Goldsbo^rough his attorney^ and the sherriffe to witt Joseph M.ccClester Gent now here returned that he had taken the af.d John Evans whose body hereat this day he had ready to answer the af.d Peter Taylor of the af.d plea as to him it was Commanded And hereupon the said John Evans puts in his place Robert Jenckins Henry Gent attorney at Law against the aforesaid Peter Taylor in the afd plea Whereupon at the request of the |
