nothing regarding butt plotting and fraudulently intending the said Sabastian Delastatius
in that part craftily and subtilly to deceive and defraud the af.d seven thousand
shingles to the same Sabastain Delastatius he hath in no sort paid or satisfyed altho'
the same to do the said Charles Ramsey by the said Sabastain Delastatius (to witt)
on the tenth day of November and in the year last above mentioned and often afterwards
at Somerset County af.d he was thereunto requested but the same to the said Sabastain
Delastatius to pay or him for the same in any sort to Content and satisfy hat
refused and still doth refuse  Whereupon the said Sabastian Delastatius saith he
is the worse and hath damage to the value of fourteen pounds Currt money of maryland
and thereupon he brings suit &a            Pledges &a  John Doe & Richard Roe

Att which day here before his Lordships Justices in Court then held at deviding Creek
in the County af.d    Came the af.d Sabastian Delastatius by his attorney af.d and the
sherriffe to witt John Henry Gent now here returned that he had taken the af.d
Charles Ramsey whose body hereat this day he had ready to answer the af.d Sabastian
Delastatius of the af.d plea as to him it was Commanded

    And the aforesaid Charles Ramsey by Francis Allen his attorney Cometh & defendeth the force
and Injury when &a and the same attorney saith that he is not Informed by the Same
Charles his Clyant of any answer for the same Charles to the afd Sabastian in the plea aforesd
to be given and nothing Els thereof Saith by which the ^same^ Sabastian remaineth against the afd
Charles thereof undefended for which the Same Sabastian his damages by Occasion of the non
performance of the promise and assumption afd against the afd Charles ought to recover
but because it is unknown what Damages the afd Sabastian has Sustained by occasion of
non performance of the promise and assumption afd the Justices here at the prayer of
the afd Sabastian and by the Consent of the afd Charles by their attorneys afd according to act
of assembly in Such Case provided assessed the damages of the Same Sabastian by occasion
of the non performance of the promise and assumption afd beyond his Costs and Charges in this part
apposed to four pounds eighteen shillings Curr.t money of Maryland

    Therefore it is Considered that the aforesaid Sabastian Delastatius recover against the afd
    Charles Ramsay his damages afd to the afd four pounds Eighteen Shillings Curr.t money of Maryland by
the Justices afd in form afd assessed as also Two hundred and Seventy Two                                   pounds
of tobacco for his Costs & Charges afd to the Same Sabastian at his request by the Court here adjudged
with Stay of Exn untill the fifteenth day of aprill then next following & the afd deft in Mercy &a
