207 of our Lord God one thousand seven hundred thirty and seven at the parish af.d in the County af.d within the Jurisdiction of this Court three hogs of the value of ten shillings Currt money of the province of maryland each hogg of the goods and Chattles of a Certain Thomas Caldwell then and there found then and there feloniously did steal take and bear away Contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the form of the act of assembly in such case lately made and provided &a Testes Thomas Caldwell Jam.s Tulley Thomas Parrimore On the foregoing Bill of Indictment it was Endorsed Ignoramus Robert Jones foreman And now to witt the third Tuesday of March at that Same Term before his Lordships Justices at Dividing Creek Came the aforesaid Robert Spear in his proper person according to a Certain Recognizance by him and his security before in that part acknowledged and prays that his appearance may be recorded & he and his Security discharged thereupon the said Robert Spears appearance is recorded and he and his security accordingly discharged &a Whereupon the said Robert Spear is ordered to give security for the payment of the severall officers fees due by means of the premisses and Indictment af.d &a Whereupon the said Robert Spear with Henry Spear of Somerset County planter present herein Court in their his proper persons acknowledged themselves Indebted unto the severall officers of Somerset County Court that hath a right to any fee or fees on the Indictment and premisses af.d In Five hundred pounds of tobacco of their bodys goods or Chattles Lands or tenements to the use of the severall officers af.d their heirs or assignes to be made and levied In case the said Robert Spear do not pay and satisfie unto the severall officers af.d their Just and rightfull fee or fees due on the Indictment and premisses af.d &a Thomas Caldwell and James Parrimore appears herein Court in their proper persons according to a Certain Recognizance by them before acknowledged to give Evidence on behalfe of his Lordship against Robert Spear and are discharged therefrom &a |
