1737 204 arms An assault did make and the same Joan then and there did beat wound and evilly treat so that of her life it was much despaired and other harms to her then and there did to the great damage of the same Joan and against the peace of the said Lord proprietary that now is his good rule and Government &a Afterwards to witt the Same third Tuesday of November Ann Dom One thousand Seven hundred and thirty Seven being the same term before his Lordships Justices at dividing Creek Came the said Mary Mackfarline in her proper person according to a Certain Recognizance by her and her Security in that part before acknowledged and had a hearing of the Indictment afd and saith that she is not thereof Guilty and of this she puts herselfe upon the Country and William Goldsborough Gent who for his said Lordship in that part followeth Likewise Therefore lett there Come a Jury thereof before his said Lordships Justices the third Tuesday of March then next following at dividing Creek in the County afd and who neither &a by which &a to recognize &a because as well &a and the Same day is given to the afd William Goldsborough who &a Whereupon the said Mary Macfarline with Joseph Macclester of Somerset County Gent her Security both present here in Court before the afd Justices acknowledged themselves Indebted unto his said Lordship the Lord Proprietary in ten pounds Sterling Each of their goods or Chattells Lands or tenements severally to be made and Levied to the Use of his said Lordship his heirs and Successors If it happen that the said Mary Macfarline do not make her personall appearance before his said Lordship Justices at the day & place last above said mentioned and do depart without Leave of the same Justices and do not answer unto his said Lordship of the Indictmt above ^said^ & do not stand and abide the Judgm.t of the Court thereon and that she be in the mean time of the good behaviour &a Att which day here before his said Lordships Justices Came againe as well the afd William Goldsborough Gent who for his said Lordship in that part followeth as the afd Mary Macfarline in her proper person according to the recognizance afd by her and her security afd acknowledged and whereupon the afd mary relinquisheth her veryfication afd by her above pretended & saith that she Cannot deny but that she is Guilty of the trespass and assault afd in the Indictment afd Specified above upon her Imposed in manner and form as by the Indictment afd above against her Supposed and the trespass and assault afd in the Indictment |
