203 County the twenty first day of march Anno Dom Seventeen hundred and thirty Seven before Robert King Esq.r and his associates the said Lord proprietary his Justices of the same County Court and for the same Lord proprietary doth give the same Justices here to understand and be informed that William Olliphant Late of Stepney parish in the County aforesaid Taylor the first day of November Anno Dom seventeen hundred thirty and seven at the parish afd in the County af.d and within the Jurisdiction of this Court then an Inhabitant of this province of maryland being did sell by Retail to John Finch of the same County planter one pint of Rum at and for a price differing from and greatly exceeding the then common and usal Rate and price of such Liquor ^between^ Merchants and others to witt for the sum of one shilling Current money of maryland to be drank in the dwelling House of the said William Ollophant at the parish afd in the County af.d and within the said Jurisdiction being and about the plantation of him the said William Ollophant being to the same house belonging and appertaining without any lawfull Licence or Authority so to do to the evil example of all others in such case offending contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the form of the act of assembly in such case lately made and provided &a wherefore the same attorney of the said Lord proprietary for the same Lord proprietary prayeth the advice of the Court herein the premisses and that due process of Law in this part against the af.d William Ollophant may be made to answer unto the same Lord proprietary of and upon the premisses &a Thereupon it was Commanded the Sheriffe of Somerset County that he Should take the said William Olliphant if he Should be found in his Bailywick and him should safe keep so that he might have his Body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of March Ann Dom one thousand Seven hundred and thirty Seven to answer unto his Lordship of and Concerning of the premisses aforesaid &.a And now to witt the third Tuesday of March being that Same term before his Lordships Justices at dividing Creek Came the said William Olliphant in his proper person and saith that he Cannot deny but that he is Guilty of the premisses afd as |
