1737 193 that now is his good rule and Government and against the form of the statute in such Case lately made and provided Robert Jenckins Henry p Dam Testes John Handy, Charles Dashiell, Henry Dashiell, Roger Train Abr: Cawdry On the foregoing Bill of Indictment it was Endorsed Vizt Billa Vera Rob.t Jones foreman Whereupon it is ordered by the Court here that the foregoing bill of Indictment and all things there unto relating be transmitted to the next assize ^nisi prius^ oyer and terminer and Goal deliver to be held at dividing Creek the first Tuesday of aprill then next following for their determination &a And thereupon it is ordered by the Court here that John Handy Charles Dashiell, Henry Dashiell Roger Train and Abraham Cordery all of Somerset County Gent Give recognizance in twenty pounds sterling Each for their appearance before the Justices of assize nisi prius oyer and terminer and Goal delivery to be held at Dividing Creek in Somerset County the first Tuesday of aprill ^then^ next to give Evidence on behalfe of his Lordship the Lord prietary proprietary against a Certain William Turner al.s James Moor &a Whereupon the said John Handy Charles Dashiell Henry Dashiell Henry Dashiell Roger Train and Abra: Cawdry all present herein Court in their proper persons acknowledged themselves Indebted unto his said Lordship the Lord Proprietary of the province of Maryland in twenty pounds sterling each good and lawfull money of England of their goods and Chattells Lands and tenements Severally to be made and Levied to the Use of his said Lordship his heirs and Successors If it happen that they the said John Handy Charles Dashiell Henry Dashiell Roger Train and Abra Cowdry do not make their personall appearance before his said Lordships Justices of assize Nisi prius Oyer and terminer and Goal delivery to be held at dividing Creek in the same County the first Tuesday of Aprill then next and do not then & there give Such Evidence as they and Each of them shall know on behalfe of his said Lordship against William Turner alias James Moor on suspicion of horse Stealing and do depart the Same Court without Leave &a James Jones Overseer of the roads in manny hundred instead of William Jones and the said James Jones for the Ensuing Year &a |
