bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek third Tuesday of November Ann Dom One thousand seven hundred and thirty seven to answer unto John Henry Gent high sher of the County afd of a plea that he Render him two hundred Sixty Six pounds Curr.t money of Maryland which to him he Owes and Unjustly detaines &a Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came the afd John Henry Gent at the same day here returned that they had taken the afd John Powell whose body here at this day they had ready to answer the afd John Henry of the afd plea as to him it was Commanded &a Afterwards to witt the same third Tuesday of November Ann Dom One thousand and seven hundred and thirty Seven at dividing Creek Cometh the afd John Powell in his proper person and the afd John Henry then and there his writt afd against the afd John Powell did not prosecute with Effect but voluntarily suffered his suit to be discontinued Therefore it is Considered that the afd John Henry take nothing by his writt afd but beine in mercy for his false Clamour and that the afd John Powell goe thereof without day &a
