Somerset ss.t  Memorand.m that at a Session of the peace of his Lordship
the right Honourable Charles absolute Lord and Proprietary of the province
of Maryland held for Somerset County at dividing Creek on the third Tuesday of
June to witt the twenty first day of the Same month Ann Dom One thousand Seven hundred and
thirty Seven before Robert King Gentleman and others his associates Justices of his the said Lord
Proprietary the peace in the County afd to Conserve and also divers feloneys trespasses and other
malefeasances in the Same County Committed to hear and determine assigned by oath of Twelve Jurors
honest and Lawfull men of the County afd Impannelled Sworn and Charged to Inquire for his
said Lordship and the body of the County afd presented that James Duffey late of Stepney
parish in the County af.d Taylor the twenty fifth day of July in the year of our
Lord God seventeen hundred thirty and six with force and arms at the parish
af.d in the County af.d within the Jurisdiction of this Court one country Cloth
Gown of the fifty pounds of tobacco and one linnen shift of the value of thirty
pounds of tobacco of the goods and Chattles of James Mumford then and there
being found then and there feloniously did steal take and bear away contrary
to the peace of the said Lord proprietary that now is his good Rule and Government
and against the form of the act of assembly in such case lately made
and provided &.a      Command was given to the sherriff of Somerset County
that he should take the af.d James Duffey if &.a to answer &.a and afterwards
to witt the Twenty first day of June one thousand Seven hundred and thirty Seven before his
Lordships Justices at dividing Creek Cometh the af.d James Duffey under Custody of
Joseph M.ccClester Gent sherriffe of the County af.d in whose Custody before that time
for the cause af.d was Committed to the barr here Led in his proper person
and being Instantly asked how he of the felony af.d in the Indictment af.d
above Specifyed will thereof acquitt himself saith that he is not thereof
guilty and thereupon of good and evill he puts himself upon the Country
