183 money and one pair of thread Stockings of the value of two shillings and six pence like money of the goods and Chattles of John Holland then and there being found then and there feloniously did steal ^take^ and bear away contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the form of the act of assembly in such case lately made and provided &a And thereupon at the Same day before his Lordships Justices of assize and Goal ^delivery^ at dividing ^Creek^ Cometh the afd James Duffey under Custody of Joseph Maclester Gent sheriffe of the County afd in whose Custody before that time for the Cause afd was Committed to the barr here Led in his proper person and being Instantly asked how he of the felony afd in the Indictment afd above specified will thereof acquitt himselfe saith that he is not thereof guilty and thereupon of good and Evill he puts himselfe upon the Country and William Goldsborough Gent who for his said Lordship in that part followeth in like manner and thereupon ye said James Duffey is Committed into the Custody of the afd Sheriff thereto remain &a Which same Indictment the af.d Justices of his said Lordship of assize and Goale delivery afterwards to witt at a County Court of his said Lordship held for Somerset County at deviding Creek in the same County the third tuesday of November Anno Dom one thousand seven hundred and thirty six before Robert King Gent and others his associated ^Justices^ of his said Lordship for the County af.d by ^their^ own proper hands delivered herein Court of Record in due form of Law to be determine Thereupon Command was given to the sherriffe of the County af.d that he should take the said James Duffey if he should be found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at deviding Creek the third tuesday of march then next following to answer unto his said Lordship of the felony af.d in the Indictment af.d mentioned &.a Att which day here before his Lordships Justices at dividing Creek Came againe as well the afd William Goldsborough who &.a as the afd James Duffey under |
