1737 182 And the Sheriffe sends not thereof his writt Therefore as before it is Commanded the sheriffe that he Cause to Come here before his Lordships Justices at dividing Creeke the third Tuesday of November then next following Twelve &a and who &a to recognize &a in form afd and the same day is given to the afd James Duffey under Custody of the afd Sheriffe and in the Interim he is Committed ^in^ to be safe Custody &a Att which day here before his Lordships Justices at Dividing Creek Cometh the afd James Duffey under Custody of the afd Sheriffe in his proper person and the Jurors ^of that Jury^ by the Sheriffe to this Impannelled being Called Likewise Came to witt John Dennis Jun.r George Tull Isaac Williams Daniel Maddox Lewis Rigsby Joshua Atkinson Tho.s Perkins Edward William John Price Jonathan Bownds John Paden James Polk who to say the truth of the premisses being Elected tryed and Sworn upon their Oath say that the afd James Duffey is guilt of the felony afd above upon him Imposed in manner and form as by the Indictment afd above Supposed Whereupon the Court here according to act of assembly in Such Case provided valued severall of the goods mentioned In the Indictment afd as followeth one petty Coat valued at four Shillings Curr.t money of Maryland One Jackett at Six Shillings Curr.t money of Maryland One apron of the value of Six pence Curr.t Money of Maryland one Childs Shirt at one shilling Like Money Two pillow Cases at two Shillings Like money one petty Coat at one shilling Like Money one pair Trowsers at ^three^ Shillings Like money one old Shirt at one Shilling Like money & one womans Shift at five Shilling Like money ^in the whole amounting to one pound three shillings & six pence Currt Money of Maryland^ Whereupon all and Singular the premisses by the Court here seen heard and fully understood It is Considered that the afd James Duffey pay unto the afd Nehemiah Holland the party deprived four fold of the value of the goods afd valued by the Court amounting to four pounds and fourteen Shillings Curr.t Money of Maryland and that the afd James Duffey stand in and upon the Pillowry Immediately at dividing Creek in the County afd the Space of a quarter of an hour and that the said James Duffey be whipt at the publick whiping post with ten Stripes on the Bare back well Laid on untill the blood appear and that the same James Duffey be taken &.a And thereupon as to the Corporall punishm.t afd Command is given to the Sher of the County afd that he do thereof Immediate Execution according to the Judgmt afd rendered |
