 Whereupon as well the said Joshua
Caldwell as the said Stephen Horsey
both present here in Court in their proper
persons Submitted their dispute in this
action to the award & determination of
Henry Ballard and Thomas Williams of Somerset County Gent according to the form of the Statute
and their award to be returned Immediately to this Court &a and afterwards in the Same Court
before the Justices thereof at dividing Creek Came here againe as well the afd Joshua Caldwell as
the afd Stephen Horsey in their proper persons and the afd Henry Ballard and Thomas Williams
returned here their award in the premisses afd in form following viz.t  To the Worshipfull Justices
in court setting pursuant to a Submission in Court by By Joshua Caldwell plantiffe and Cap.t
Stephen Horsey defend.t wee have Examined and Stated the accounts to us referred and do find
the ballance in favour of the plantiffe Joshua Caldwell Eleven hundred and Seven pounds
of tobacco                                                                  Thomas Williams & Henry Ballard

    Which award being read and by the Court heard      Therefore it is Considered that the
aforesaid Joshua Caldwell recover against the afd Stephen Horse Executor of the Same
Hannah Horsey his damages afd to Eleven hundred and Seven pounds of tobacco by the
246   arbitrators afd in form afd awarded as also
pounds of tobacco for his Costs and Charges to the same Joshua at his request by the Court
now here of his assent adjudged of the goods and Chattells which were of the afd Hannah at the
time of her death if so much in his hands he hath and if so much in her hands he hath not then
the Costs afd to be Levied of the proper goods and Chattells of the afd stephen and the afd
Stephen in Mercy &a

of Maryland held for the County of Somerset at dividing Creek in the same
