179 but the same to him hitherto to pay altogether hath refused and denyed and still doth refuse and deny to the damage of him the said Thomas Nevett thirty pounds seventeen shillings and two pence sterling and thereof brings suit &a Pledges &.a J: Doe & R Roe And the af.d William Macclemmey in his own proper person cometh and defendeth the force and Injury when &a and saith that he Cannot deny the action af.d of the af.d Thomas Nevett nor but that he did assume upon himself in manner and form as the af.d Thomas Nevett above against him hath Complained and as to the damage of the same Thomas by him by occasion of the premisses in that part the same William Macclemmey saith and acknowledgeth that the af.d Thomas hath sustained damages by occasion of the premisses beyond his Costs and Charges by him about his suit in that part in that part apposed to thirty pounds seventeen shillings and two pence sterling and not more and because the af.d Thomas denys not this but the same allegation bleives to be true prays Judgment for those damages above acknowledged together with his Costs and Charges af.d to him to be adjudged &a Therefore by Consent of the parties af.d it is considered that the af.d Thomas Nevett recover against the af.d William Macclemmey his damages af.d to the af.d to thirty pounds seventeen shillings and two pence ^sterling^ by the same William in form af.d acknowledged as also pounds of tobacco for his Costs and Charges af.d to the same Thomas at his request by the Court now hereof the assent of the parties af.d adjudged which certain damages in the whole amounts to thirty pounds 423 Seventeen Shillings and two pence Sterling and pounds of tob.o with Stay of Execution untill the twentieth day of December next following and the afd William in Mercy &a
