1737 178 twenty five pounds nine Shillings and seven pence Sterling in the said first bill of Exchange Specified unto the said Thomas Nevett according to the form of the said first Bill of Exchange & the Endorsment thereupon as afd of all which said premisses the said Thomas Nevett afterwards (to witt) the tenth day of May One thousand seven hundred and thirty Seven at Somerset County afd unto the said William MccClemmey did give notice by pretext of which premisses the afd William MccClemmey by reason of his Indorsment upon the said first bill of Exchange as afd according to the Use and Custom of Merchants for the whole time afd as before used and approved became and was Chargable to pay the said Thomas Nevett the afd Twenty five pounds nine shillings and seven pence Sterling in the afd first bill of Exchange mentioned with all the Lawfull damages Costs and Interest by the said Thomas Nevett Suffered and Sustained for want of due acceptance of the said first bill of exchange and by occasion of the nonpayment of the Contents thereof to the said Thomas Nevett or order and thereupon the said William M.ccClammey afterwards (to witt) the same day and year last mentioned at the place af.d in Consideration of the premisses upon himself did assume and to the said Thomas Nevett then and there faithfully promised that he the af.d William M.cClemey the af.d twenty five pounds nine shillings and seven pence sterling with all Lawfull Costs damages and Interest by the said Thomas Nevett suffered and sustained by occasion of the non acceptance of the said first bill of exchange and non payment of the contents of the same which amount unto four pounds seven shillings and seven pence sterling whereof the said William Macclemmey the day year and place last mentioned had nottice Nevertheless the said William Macclemmey his promise and assumption af.d nothing regarding but minding and fraudulently intending the said Thomas Nevett in this part craftily and subtilly to deceive and defraud the af.d twenty five pounds nine shillings and seven pence sterling together with all Lawfull Costs damages and Interest af.d which in the whole amount unto the sum of thirty pounds seventeen shillings and two pence sterling or any part thereof to the af.d Thomas Nevett hath not paid altho' to do the same the af.d William Macclemmey (to witt) the same day and year last mentioned and often afterwards at Somerset County af.d by the af.d Thomas Nevett he was required but |
