174 deviding Creek in the County af.d one dark bay coloured Gelding being the proper goods and Chattles of a Certain John Evans with force and arms unlawfully did take and Imprison and the same Gelding so as af.d Imprisoned being with force and arms unlawfully did disfigure and from the tail of the same Gelding then and there the hair thereof did with force and arms unlawfully cut of to the great damage of the said John Evans and against the peace of the Right honourable the Lord proprietary his good rule and Goverment &a and the af.d bill of Indictmt in form af.d written & in it the af.d false Scandelous and malitious matter above recited containing afterwards to wit on the day and year last af.d to the af.d Justices of the said Lord proprietary at a special Court of oyer and terminer and Goal delivery on the day and year af.d by the said Justices for the County af.d at deviding Creek af.d held did cause to be delivered which bill of Indictment the said Justices of the af.d John Evans then and there did receive and the said bill thereupon to the Jurors of the grand Inquest for the said County at the said Goal delivery upon the holy evengelist of almighty God then and there charged and sworn then and there did deliver to enquire and the truth of and Concerning the matter in the said bill Contained to present which matter in the said bill contained afterwards to wit the day and year last af.d at the County af.d to the Jurors af.d to be false and malitious and by the said John Evans false and malitiously against the said Wonney to be devised and Invented did appear and by means thereof after evidence in and concerning the ^premises^ to them fully given then and there gave their virdict and answer in and Concerning the bill of Indictment af.d that they the said Jurors of the matter af.d in the af.d bill of Indictment Specifyed and contained were Ignorant and the af.d Wonney says that he by means of the premisses not only i his good name fame and Credit much hurt and damnifyed doth appear but also twelve hundred and forty pounds of tobacco ^and^ sundry other sums of tobacco and money to Clear himself from the prosecution af.d and and also by means of the said prosecution was forced to expend whereupon he |
