he says he is damnifyed four thousand pounds of tobacco and thereof he brings
suit &.a                                                                        Pledges &.a J Doe & R Roe

    And the af.d John Evans by William Beckingham his attorney Comes and defends
    the force and Injury when &a and prays Leave thereof to Imparle here untill
    the third tuesday of November Anno Dom one thousand seven hundred and
    thirty seven and he hath it and the same day is given to the af.d Wonney her
    also &.a      Att which day here before his Lordships Justices at deviding Creek
    came againe as well the af.d Wonney Macclemmey as the af.d John Evans
    by their attorney af.d and whereupon the same Wonney then and there his writt
    afd against the afd John Evans did not prosecute with Effect but voluntarily sufered
    his suit to be discontinued
                                                    therefore afterwards to witt that Same day by
    discretion of his said Lordships Justices here were adjudged to the same John Evans
665    Six hundred and Eighty Seven            pounds of tobacco for his Costs and Charges  
by him about his defense in that part Sustained according to the form of the Statute in
such Case thereof Lately made and provided and the afd Wonney in Mercy and that
the afd John have thereof Execution &a

     Command was given to the sherriffe of Somerset
County that he should take Robert Collier Late of
Somerset County planter if he should be found in his bailywick and him
should safe keep so that he might have his body before the Justices of his
Lordships County Court of Somerset to be held at deviding Creek the third tuesday
of June Anno Dom one thousand seven hundred and thirty seven to answer
unto Wonney Macclemmey of a plea of trespass upon the Case &a

Att which day here before the Justices of his Lordships County Court of Somerset
at deviding Creek Came the af.d Wonney Macclemmey by George Douglas his
attorney and the sherriffe to witt Joseph M.ccClester Gent at the same day here
returned that he had taken the af.d Robert Collier whose body hereat this day
he had ready to answer unto the af.d Wonney Macclemmey of the af.d plea as to him it
was Commanded            And Whereupon the same Robert ^Collier^ puts in his place
