against the said John Evans in the plea afd in form following vizt Somerset ss.t  John
Evans Late of Somerset County planter was attached to answer unto Wonney MaClemmey of
a plea of trespass upon the Case &a

And Whereupon the said Wonney by George Douglas ^his attorney^ complains that whereas
the said Wonney is good true and peaceably Subject of our Lord the King now
as a good true peaceable and inoffensive subject of ^our^ said Lord the King and his
progenitors Kings and Queens of this Realm from the time of his nativity
hitherto himself hath demeaned and from Cutting the hair from horses
tails or in any sort them disfiguring or any such base trespass or Crime or any
Suspicion thereof himself free clear unspotted and unsuspected by all the
time af.d ^hath^ behaved and Governed  Nevertheless the said John Evans not
Ignorant of the premises but malitiously intending the said Wonney not only
in his good name af.d to hurt but also the said Wonney unjustly to vex and
trouble and him sundry sums of money and tobacco to cause to expend
on the twenty first day of December Anno Dom MDCCXXXvi at the County af.d
falsly and malitiously without any cause or Colour of any trespass imprisonment
or disfiguring of the horse or Gelding of the said John Evans by the said Wonney
Committed against him the af.d Wonney before the Honourable Levin Gale
Esq.r Coll Robert King M.r William Stoughton Coll George Dashiell
His Lordships the Right Honourable Charles absolute Lord and proprietary
of the provinces of maryland and avalon Lord Baron of Baltemore &.a Justices
of a speciall Court of oyer and terminer and Goal delivery held at deviding
Creek in the County af.d on the said twenty first day of december Anno Dom
MDCCXXXvi a Certain bill of Indictment to be written did cause which bill
of Indictment did contain the fasle and Scandalous matter following vizt
His Lordship a Wonney Macclemmey Somerset County ss.t  The Jurors
for the Right Honourable the Lord proprietary that now is for the body
of Somerset County upon their oath do present that Wonney M.ccClemmey
late of Somerset County planter the twenty first day of december in the year
of our Lord seventeen hundred and thirty six at the Court house at
