of the premisses to him to be adjudged &.a      Whereupon all and Singular the premisses by
the Court here being seen heard and fully understood and mature deliberation thereupon had for that it seemeth
to the Court here that the declaration afd and the matter in the Same Contained are not Sufficient in
Law to the action aforesaid of the afd Nathaniel against the afd Thomas to have and maintain &a

    Therefore it is Considered that the aforesaid Nathaniel Carrington take nothing by his writt afd
    bur for his false Clamour be thereof in Mercy and that the afd Thomas Storow go thereof without
day &.a and further it is Considered that the afd Thomas Storow recover against the afd Nathaniel
378   Carrington   Three hundred and Seventy Eight                     pounds of tobacco for his Costs and
Charges by him about his defence in that part Sustained to the Same Thomas by the Court now here of
his assent according to the form of the statute in such Case lately made and provided adjudged and that
the afd Thomas have thereof Execution &a

    Command was given to the sherriffe of Somerset County that
he should take John Evans late of Somerset County planter if
he should be found in his bailywick and ^him^ should safe keep so that
he might have his body before the Justices of his Lordships County Court of Somerset
to be held at deviding Creek the third tuesday of June Anno Dom one thousand
seven hundred and thirty seven to answer unto Wonney Macclemmey of a plea of
trespass upon the Case &.a      Att which day here before the Justices of his Lordships
County Court of Somerset at deviding Creek Came the af.d Wonney Macclemmey by George
Douglas his attorney and the sherriffe to witt Joseph M.ccClester Gent at the
same day here returned that he had taken the af.d John Evans whose body
hereat this day he had ready to answer the af.d Wonney M.ccClemmey whose of
the af.d plea as to him it was Commanded      And whereupon the same John
Evans puts in his place William Beckingham Gent attorney at Law against the afd Woney
Macclemmey of the afd Plea   Whereupon at the request of the parties day is given to
the parties afd here before his Lordships Justices at dividing Creek ^untill^ the third Tuesday of
August then next following to be in the Same State as at present Saving to the parties &a

             Att which day here before his Lordships Justices at dividing Creek Came as well
the afd Wonney as the afd John by their attorneys afd and hereupon the said Wonney declared
