172 Justices of his Lordships County Court of Somerset to be held at deviding Creek the third tuesday of March Anno Dom one thousand seven hundred and thirty six to answer unto Nathaniel Carrington of a plea of trespass upon the Case &a Att which day here before the Justices of his Lordships County Court of Somert at deviding Creek Came the af.d Nathaniel Carrington by Geo: Douglas his attry and and the sheriffe to witt Joseph Macclester Gent at the same day here returned that he had taken the af.d Thomas Storow whose body hereat this day he had ready to answer the af.d Nathaniel Carrington of the af.d plea as to him it was Commanded hereupon the said Nathaniel Carrington declared against the af.d Thomas Storow in the plea af.d in form following vizt Somerset ss.t Thomas Storow late of Somerset County marriner was attached to answer unto Nathaniel Carrington of a plea of trespass upon the Case &a And Whereupon the said Nathaniel by George Douglas his attorney complains that whereas the said Nathaniel on the first day of December Anno Dom seventeen hundred thirty and six at the County af.d on Consideration that he the said Nathaniel ^had^ delivered into the hands of the said Thomas six hundred seventy six and one half Galons of Rum and seventeen hundred eighty and five pounds of Sugar to be sold by the said Thomas for wheat or Current money of Virginia for the use of the said Nathaniel and that he the said Nathaniel had then and there promised to pay the said Thomas as much money as he the said Thomas sho^u^ld reasonably deserve for his trouble and expence in and about such sale he the said Thomas upon himself did assume and to the said Nathaniel then and there ^faithfully^ promised that he the said Thomas af.d quantity of Rum and Sugar for the use of the said Nathaniel for wheat or Currt money of verginia would sell and afterwards of the money or wheat arising from such sails would account with to the said Nathaniel when afterwards he should be thereto required and altho' the said Nathaniel hath always been ready to pay to the said Thomas as much money as he should reasonably deserve for his trouble in disposing of the said Goods ^and Merchandize^ Nevertheless the af.d Thomas Storow his promise and |
