Att which day here before his Lordships Justices at deviding Creek ^came^ againe as
well the the af.d Thomas Fletcher as the af.d Walter Codd by their attorney af.d
and whereupon the same Walter Codd as before defends the force and Injury when
&.a and says he did not assume upon himself in maner and form as the said
Thomas above against him hath Complained and of this he putts himself
upon the Country   And the af.d Thomas in like manner            Therefore
Immediately ^lett^ Cometh there of the Jury before his Lordships Justices at dividing Creek this
Instant third Tuesday of November by which &.a and who neither &.a to recognize &.a because
as well &.a and the Jurors of that same Jury by John Henry Gent Sheriffe of the County afd
to this Impannelled being Called Came to witt George Tull Isaac Williams Benjamin Holland
John Perkins Nehemiah Holland John Price Jonathan Bounds Samuel Handy Joshua
Atkinson Thomas Peal Isaac Marshall Robert Mitchell who to Say the truth of the premisses
being Elected tryed and sworn upon their Oath say that the afd Walter Codd did assume upon himselfe
in manner and form as the fad Thomas Fletcher above against him hath Complained and
assessed the damages of the same Thomas by occasion of the non performance of the promise &
assumption afd by him about his suit in that part apposed to thirteen pound & one shilling
Curr.t money of Maryland and for those Costs and Charges to one pound of tobacco

             Therefore it is Considered that the afd Thomas Fletcher recover against the
afd Walter Codd his damages afd by the Jurors afd in form afd assessed as also
928                                                         pounds of tobacco for his Costs and Charges afd to the same
Thomas by the Court now here of his assent of Increase adjudged which Certain damages in the
whole amounts to thirteen pounds & one Shilling Curr.t money of Maryland and
                                                 pounds of tobacco and the afd Walter in Mercy &a
