171 Whereupon Came hereinto Court a Certain James Martin late of Somerset County Gent and undertook for the said Walter Codd and assumed upon himself (Likewise the said Walter Codd present herein Court in his proper person assumed upon himself) that if it should happen that Judgment in the plea af.d should be rendred for the same Thomas Fletcher against him the said Walter or that the said Walter should be therein convicted that then he the same Walter should pay and Satisfie unto the said Thomas the Judgment of the Court thereupon or render his body in execution of such Judgment to the prison of the sheriffe of the County af.d thereto remain untill the same Judgment be fully satisfyed or that he the said James Martin will do the same for him &.a And the aforesaid Walter Codd by George Douglas his attorney Comes and defends the force and Injury when &a and prays Leave thereof to Imparle here untill the third Tuesday of march ann Dom One thousand Seven hundred and thirty Six and he hath it and Same day is given to the afd Thomas here also &a Att which day here before his Lordships Justices Court at dividing Creek came againe as well the afd Thomas Fletcher as the afd Walter Codd by their attorneys aforesaid and whereupon the same Walter prays further Leave thereof to Imparle here untill the third Tuesday of June then next following and he hath it and the same day is given to the afd Thomas here also &a Att which day here before his Lordships Justices at deviding Creek came againe as well the af.d Thomas Fletcher as the af.d Walter Codd by their attorneys af.d and Whereupon the same Walter prays further Leave thereof to Imparle here untill the third tuesday of August then next following and he hath it and the same day is given to the af.d Thomas here also &.a Att which day here before his Lordship Justices at deviding Creek came again as well the af.d Thomas Fletcher as the af.d Walter Codd by their attorneys af.d And Whereupon the same Walter prays further Leave thereof to Imparle here untill the third due tuesday of November then next following and he hath it and the same day is given to the af.d Thomas here also &.a Att |
