hundred and thirty two at the County of Somerset af.d within the Jurisdiction of this
Court was Indebted unto the said Thomas in six thousand eighty and four pounds of tobacco
for so much by the said Walter on account and for the use of him the said Thomas
at the place af.d before that time had and received as by account hereunto annexed may
in Court appear and being so thereof Indebted the said Walter in Consideration thereof
afterwards to witt the day and year af.d at the place af.d upon himself did assume and
to the said Thomas then and there did faithfully promise that he the said Walter the
af.d six thousand eighty and four pounds of tobacco to the said Thomas when he sho^u^ld
be thereunto requested well and faithfully he would pay and Content and altho' the
said Walter three thousand nine hundred ninety five and three quarters pounds of tobacco
to the said Thomas parcell of the af.d six thousand quarters eighty and four pounds
of tobacco he hath paid and satisfyed Yett as to two thousand eighty eight and one quarter
pounds of tobacco residue of the af.d six thousand eighty and four pounds of tobacco
the said Walter his promise and assumption af.d ^in form afd^ made nothing regarding but plotting
and fraudulently intending the said Thomas in that part craftily and Subtilly to
deceive and defraud the said two thousand eighty eight and a quarter pounds of tobacco
to the said Thomas altho' the same to doe the said Walter by the said Thomas on the
af.d thirtieth day of October in the year af.d and often afterwards at Somerset
County af.d he was there unto requested hath not paid or Contented but the same to
him heitherto to pay or Content hath refused and still doth refuse and deny to
the damage of the said Thomas Forty pounds Currt money of maryland and
thereupon he brings suit &.a                                    Pledges &a J Doe and R Roe
