    November Court    1737                     167

Often since that time at the County afd the said fifty pounds to the said Ann since the death of the said
Alexander to render hath been required whereupon the said Ann says she is the worse fifty pounds Curr.t
money of Maryland and thereof She brings suit and the said Ann also here into Court brings the Letters
testamentary of the said Alexander Draper by which it ^sufficiently^ appears to the Court that the said Ann is Exrx
of the testament and Last will of the said Alexander the testator and thereof to have administracon
&a                                                                                    pledges &.a  Jno Doe & R Roe

          Whereupon at the prayer of the afd Robert Given the Executor the said Ann Draper
is adjudged by the Court here to give Security for Costs in Case nonsuit be Obtained against her in
the plea afd which is by the Court hereunto him granted    thereupon a Certain William Draper of Somerset
County planter present herein Court in his proper person undertakes for the said Ann Draper
that in Case she be nonsuited in the plea afd or otherwise Legally Cast that then the said Anne
Draper shall pay the Condemnation of the Court and all Costs accrewing thereon to the said
Robert Givan the Ex.r or that he the said William Draper will doe the same for her &a

             And the afd Robert Givans by Francis Allen his attorney Cometh & defendeth the force
and Injury when &a and prayeth Leave thereof to Imparle here untill the third Tuesday of
March anno Dom One thousand Seven hundred & thirty Six and he hath it and the same day
is given to the afd Ann here also &a

                   Att which day here before his Lordships Justices at dividing Creek Came againe as well
the afd Ann Draper as the afd Robert Givan by their attorneys afd  And whereupon the said
Robert Given prays further Leave thereof to Imparle here untill the third Tuesday of June
then next following and he hath it and the same day is given to the afd Ann here also &a

Att which day here before his Lordships Justices at dividing Creek Came again as well the af.d
Ann Draper as the af.d Robert Givan by their attorneys af.d and whereupon the said
Robert Givan prays further Leave thereof to Imparle here untill the third Tuesday of August
then next following and ^he^ hath it and the same day is given to the af.d Ann here also &.c

Att which day here before his Lordships Justices at dividing Creek Came again as well the af.d
Ann Draper as the aforesaid Robert Givan by their attorneys af.d and whereupon the said
Robert Givan prays further Leave thereof to Imparle here untill the Third Tuesday of November
then next following and he hath it and the same day is given to the af.d Ann here also &.c

Att which day here before his Lordships Justices at dividing Creek Came again as well the af.d Ann
Draper as the af.d Robert Givan by their attorneys af.d    And whereupon the same Robert Givan as
before defends the force and Injury when &.a and prays the hearing of the writing Obligatory afd and
