Ex.r of the testament and last Will of Robert Givan Late of
Somerset County planter dec.d otherwise ^lately^ Called Robert Givan
of the parish of Stepney and County of Somerset was sumoned
to answer unto Ann Draper Ex.rx of the testament and last
Will of Alexander Draper of a plea that he render unto her the sum of fifty pounds
Currant Money of Maryland which from her he unjustly Detaines &.c

And whereupon the said Ann by George Douglas her attorney says that whereas
a Certain William Givan and the af.d Robert Givan the testator in their life time to wit on
the twenty fifth day of December Ann Dom seventeen hundred thirty and three at
Somerset County af.d within the Jurisdiction of this Court by their Certain writing
obligatory which the said Ann sealed with the seals of the said William Givan and Robert
Givan the testator here into Court bring whose date is the day and year af.d did acknowledge
them selves to be holden and firmly stand bound to the said Alexander Draper in his
life time in the Sum of fifty pounds Currant money of Maryland to be paid to the said Alex.d
Draper his Certain attorney Executors administrators or assigns when they the said William Givan
and Robert the testator should be after that time thereto required and ^to^ the faithfull payment
of the said fifty pounds did bind themselves their heirs Executors and Administrators firmly
by that writing obligatory an the af.d Ann in fact says that in the life time of the said Robert
Givan the testator the said William Givan dy'd and was surviv'd by the said Robert Givan
the testator the said Debt or any part thereof to the said Alexander at the death of the
said William being in no sort satisfyd or paid by which Action did Acrue to the said
Alexander in his life to require and have of the said Robert Givan the testator in his life
time the said fifty pounds Current money of Maryland  Nevertheless the said Robert Givan
the testator in is Life time or the said Robert Ex.r of the testament and Last will of the
said Robert the testator the said fifty pounds to the said Alexander in his Life time or
the said Ann Exrx of the Alex.d since his death have not rendered nor hath Either of
them Rendered but that to doe have altogether denyed and the said Robert Ex.r of the
said Robert the same to the said Ann to render still doth deny and Unjustly detaine
altho' the same to the said Alexander in his Life time to render the said Robert the testator
after the death of the said William to witt on the Eleventh day of Aprill ann Dom MDCCXXiii
at the County afd and often afterwards by the said Alexander in his Life time and the said
Ann after the death of the said Alexander was required and altho' the said Robert ^Exr of the said Robert since the death of the said Robert^ the
testator to witt on the first day of May Ann Dom Seventeen hundred thirty and Six and
