168 it is read unto him &a he also prays ye hearing of the Condition of the Same Writing and it is read unto him in these words following viz.t The Condition of the above obligation is such that if the above bounden William Givan and Robert Givan their heirs Executors administration or assignes shall well and truly pay or Cause to be paid to the above named Alexander Draper his heirs Executors or administrators the full sum of twenty five pounds Lawfull money of Maryland by and upon the tenth day of April next Ensuing the date whereof without fraud or delay that then this present obligation to be void and of none effect or else to remain in full force and virtue he also prays the hearing of the Letters Testamentary of the said Alexander Draper and it is read to him in these words following vizt sessex super delaware Jacob Hollock Esq.r Dep.t Reg.r appointed for the probate of wills and Granting Letters of administration for the County af.d by vertue of a Commission from the Honourable patrick Gordon Esq.r by his majesty Royall approbation ^&^ appointment Gove.r of the Counteys ^of^ new Castle Kent and sussex upon Delaware and province of Pensilvania to me directed to all to whom these presents shall Come Greting &.c Know ye that on the twelfth day of March Ann Dom 1734 before me the said Jacob Hollock the Last will and testament of Alexander Draper of the County of Sussex af.d merchant dec.d annexed and at the time of his death sundry goods Chattells rights and Creditts within the said County of Sussex by means whereof the full disposition of all and Singular the goods & Chattells rights and Creditts of the said decd and the granting admrcon of them also the hearing of acc.t Calculati.o or reckoning of the said Administration and the final discharge and dismission from the Same by virtue of the authority aforesaid unto me alone and not to another inferiour Judge are manifestly known to belong and ^the^ administration of all and Singular the goods Chattells rights and Credits of the said decd and his Last Will and testament any manner of ways Concerning was Granted unto Ann Draper Executrix in the will Named cheify If well and truly administring the same and making a true and perfect Inventory of all and Singular the goods Chattells and Creditts of the said dec.d and Exhibitting of the same into the Reg.rs office at Lewis in the County of Sussex afd on or before the twelfth day of June next Ensuing and of render a true and Just account being solemnly sworn there unto in testimoney whereof I have affixed the seal of the said office to these presents at Lewis af.d the day and year first ^above^ written test Jacob Hollock Depr R: which being read and heard the said Robert prays Judgment of the Declaration af.d because he saith that that the Declaration af.d and the matter in the same Contained are not sufficient in Law for the af.d Anne her Action af.d against him the said Robert thereupon to have and maintain to which Declaration the said Robert hath no need or by the Law of the land is he held in any sort to answer and this he is ready to verifie wherefore for want of a Sufficient Declaration in that part the said Robert prays |
