162 and thirty Seven to answer unto John Atkinson of a plea that he render unto him One hundred and Seventy Eight pounds Curr.t money of maryland and Eight hundred and fifty pounds of tobacco good sound merchantable Leafe tobacco in Cask to Containe the Same which to him he owes and unjustly detaines &a Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came the afd John Atkinson by Francis Allen his attorney and the Sheriff to witt John Henry Gent at the Same day here returned that he had taken the afd Charles Ramsey whose body here at this day he had ready to answer the afd John Atkinson of the afd plea as to him it was Commanded And hereupon the said John Atkinson declared against the afd Charles Ramsey in the plea afd in form following viz.t Somerset County ss.t Charles Ramsey late of Somerset County planter al dict Charles Ramsey of the said County planter was summoned to answer unto John Atkinson of the said County planter of a plea that he render unto him one hundred seventy eight pounds Currt money of maryland and eight hundred and fifty pounds of good sound merchantable leafe tobacco in Cask to contain the same which to him he owes and unjustly detains &a And Whereupon the said John Atkinson by Francis Allen his attorney saith that whereas the said Charles on the seventeenth day of August Anno Dom seventeen hundred and thirty six at the County of Somerset af.d within the Jurisdiction ^of this Court^ by his certain writing obligatory which the said John with the seal of the said Charles hereinto Court brings the date whereof is the same day and year did acknowledge himself to be bound unto the af.d John in the af.d one hundred seventy eight pounds Currt money of Maryland and eight hundred and fifty pounds of tobacco good sound merchantable leafe tobacco in Cask to Contain the same to be paid unto the af.d when he should be thereunto required Yett the said Charles tho' often required the said one hundred seventy eight pounds Currt money of maryland and eight hundred and fifty pounds of good sound merchantable leafe tobacco in Cask to Contain the same to the said John hath not rendred but the same to him hitherto to render hath denyed and still doth deny and unjustly detain whereupon he saith he is ^worse^ and hath damage to the value of twenty pounds Currt money of maryland and thereupon he brings suit &.a Pledges &a J Doe R Roe |
