Command was given to the Sheriffe of Somerset County that he should take John
Henderson Late of Somerset planter al dict John Henderson of the said County
                   planter if he should be found in his bailywick and him should safe keep so that he might have
his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in
the same County the third Tuesday of November ann Dom One thousand Seven hundred & thirty seven
to answer unto John Atkinson ^of ye sd Coty^ of a plea that he render unto ^him^ One hundred Seventy Eight pounds
Currt money of maryland and eight hundred and fifty pounds of good sound merchantable
leafe tobacco in Cask to Contain the same which to him he owes and unjustly detains &.a

    Att which day here before the Justices of his Lordships County Court of Somerset
at deviding Creek Came the af.d John Atkinson by Francis Allen his attorney
and the sherriffe to witt John Henry Gent at the same day here returned that he had
taken the af.d John Henderson whose body hereat this day he had ready to answer
the af.d John Atkinson of the af.d plea as to him it was Commanded

    And hereupon the said John Atkinson declared against the af.d John Henderson
in the plea af.d in form following vizt Somerset County sst John Henderson
late of Somerset County planter al dict John Henderson of the said County
planter was summoned to answer unto John Atkinson of the said County planter
of a plea that he render unto him one hundred seventy eight pounds Currt money
of maryland and eight hundred and fifty pounds of Good sound merchantable
leafe tobacco in Cask to Contain the same which to him he owes and unjustly
detains &a

    And Whereupon the said John Atkinson by Francis Allen his
attorney saith that whereas the said John Henderson on the seventeenth day
of August Anno Dom seventeen hundred and thirty six at the County of
Somerset af.d within the Jurisdiction of this Court by his certain writing
obligatory which the said John Atkinson with the seal of the said John
he Henderson sealed hereinto Court brings the date whereof is the same day
and year did acknowledge himself to be bound unto the said John Atkinson in
the af.d one hundred seventy eight pounds Currt money of maryland and eight
