And Whereupon the said John by Francis Allen his attorney saith that
whereas the af.d William the seventeenth day of August Anno Dom seventeen
hundred and thirty six at the County of Somerset af.d within the Jurisdiction of
this Court by his certain writing obligatory which the said John with the seal of
the said William sealed hereinto Court brings the date whereof is the same day
and year did acknowledge himself to be bound unto the said John in the af.d
one hundred seventy eight pounds Currt money of maryland and eight hundred
and fifty pounds of good sound merchantable leafe tobacco in Cask to Contain in
the same to be paid unto the af.d John when he should be thereunto required yett
the said William tho' often required the said one hundred seventy eight pounds
Currt money of maryland and eight hundred and fifty pounds of good sound
merchantable leafe tobacco in Cask to Contain the same to the said John hath
not rendred but the same to him hitherto to render hath denyed and still doth
deny and unjustly detain whereupon he saith he is worse and hath damage to
the value of twenty pounds Currt money of maryland and thereupon he brings
suit &.a                                                                  Pledges &.a J: Doe & R Roe

    And the af.d William Kitchen by William Beckingham his attorney Cometh
and defendeth the force and Injury when &a and saith that he Cannot deny the
action af.d of the af.d John nor but that the writing obligatory af.d is the deed
of the same William nor but he oweth the same John the af.d one hundred
seventy eight pounds Currt money of maryland and eight hundred and fifty
pounds of good sound tobacco in manner and form as the af.d John above against
him declared
                               Therefore it is Considered that the af.d John Atkinson
recover against the af.d William Kitchen his debt af.d and his damages by
occasion of the detaining the same debt to
pounds of tobacco to the same John of his assent by the Court here adjudged with
stay of execution untill the twe^n^tieth day of August then next following and
the af.d William in mercy &.a
