the af.d John nor but that he oweth the writing obligatory af.d to the deed of the same Thomas nor
but he oweth the same John the af.d one hundred seventy eight pounds Currt money of maryland
and eight hundred and fifty pounds of tobacco in manner and form as the af.d John above
against him declared      Therefore it is Considered ^that^ the af.d John Atkinson recover against
the af.d Thomas Lambden his debt af.d and his damages by occasion of the detaining

      William Kitchen

Command was given to the sherriffe of Somerset County that he should
take William Kitchen late of Somerset County Mercht al dict William
Kitchen of the said County Merchant if he should be found in his bailywick
and him should safe keep so that he might have his body before the Justices of his
Lordships County Court of Somerset to be held at dividing Creek the third tuesday of
November Anno Dom one thousand seven hundred and thirty seven to answer unto
John Atkinson of the said County planter of a plea that he render unto him one hundred
seventy eight pounds Currt money of maryland and eight hundred and fifty pounds
of good sound merchantable leafe tobacco in Cask to Contain the same which to him he
owes and unjustly detains &.a

Att which day here before the Justices of his Lordships County Court of Somerset at
deviding Creek Came the af.d John Atkinson by Francis Allen his attorney and the
sherriff to witt John Henry Gent at the same day here returned that he had taken the
af.d William Kitchen whose body hereat this day he had ready to answer the af.d
John Atkinson of the af.d plea as to him it was Commanded &.a

And hereupon the said John Atkinson declared against the af.d William Kitchen
in the plea af.d in form following vizt Somerset County sst  William Kitchen
late of Somerset County Mercht al dict William Kitchen of the said County merchant
was summoned to answer unto John Atkinson of the said County planter
of a plea that he render unto him one hundred seventy eight pounds Currt money
of maryland and eight hundred and fifty pounds of good sound merchantable leafe
tobacco in Cask to Contain the same which to him he owes and unjustly detains &a
