160 to witt John Henry Gent at the same day here returned that he had taken the af.d Thomas Lambden whose body hereat this day he had ready to answer the af.d John Atkinson of the af.d plea as to him it was Commanded and the same sherriffe further returned that he had served the same Thomas with a Copy of the declaration af.d according to act of assembly in such case made and provided &a And hereupon the said John Atkinson declared against the af.d Thomas Lambden in the plea af.d in form following Viz.t Somerset County sst Thomas Lambden late of Somerset County merch.t al dict Thomas Lambden of Somerset County Mercht was summoned to answer unto John Atkinson of the said County planter of a plea that he render unto him one hundred seventy eight pounds Currt money of maryland and eight hundred and fifty pounds of good sound merchantable leafe tobacco in Cask to Contain the same which to him he owes and unjustly detains &.a And Whereupon the said John by Francis Allen his attorney saith that whereas the af.d Thomas the seventeenth day of august Anno Dom seventeen hundred and thirty six at the County of Somerset af.d within the Jurisdiction of this by his certain writing obligatory which the said John with the seal of the said Thomas sealed hereinto Court brings the date whereof is the same day and year did acknowledge himself to be bound unto the said John in the af.d one hundred seventy eight pounds Currt money of maryland and eight hundred and fifty pounds of good sound merchantable leafe tobacco in Cask to contain the same to be paid unto the said John when he should be thereunto required Yett the said Thomas tho' often required the said one hundred seventy eight pounds Currt money of maryland and eight hundred and fifty pounds of good sound merchantable leafe tobacco in Cask to contain the same to the said John hath not rendred but the same to him hitherto to render hath denyed and still doth deny and unjustly detains whereupon the said John saith he is worse and hath damage to the value of twenty pounds Currt money of maryland and thereupon he brings suit &.a Pledges &a J Doe R Roe And the af.d Thomas Lambden by William Beckingham his attorney Cometh and defendeth the force and Injury when &.a and saith that he Cannot deny the action af.d of the |
