by the afd Sheriffe to this Impannelled being Called Came to witt John Scarbrough John Atkinson
Thomas Newbold Isaac Williams Samuel Handy George Tull John Perkins William Mills John
Price Jonathan Bownds Joshua Atkinson John Merrill who to say the truth of the premisses
afd being Elected tryed and Sworn upon their Oath say that the afd Benjamin Henderson did
assume upon himselfe in manner and form as the afd William Conner above against him hath
Complained and aposed the damages of the afd William by occasion of the non performance of
the promise and assumption afd beyond his Costs and Charges by him about his suit in that
part apposed to four pounds Eight Shillings Curr.t money of Maryland and for those
Costs and Charges to one pound of tobacco

             Therefore it is Considered that the afd William Conner recover against the afd
Benjamin Henderson his damages afd by the Jurors aforesaid in form afd assesed as also

same William by the Court now here of his assent of Increase adjudged which Certain damages
in the whole amounts to four pounds Eight Shillings Currt money of Maryland and

that he should take Thomas Lambden late of Somerset County
Merchant al dict Thomas Lambden of Somerset County mercht
if he should be found in his bailywiock and him should safe keep so that he might have
his body before the Justices of his Lordships County Court of Somerset to be held at
deviding Creek the third tuesday of November ann Dom ^one thousand seven hundred and thirty Seven^ to answer unto John Atkinson
of the said County planter of a plea that he render unto him one hundred seventy eight
pounds ^Currant money of Maryland^ and eight hundred and fifty pounds of good sound merchantable leafe tobacco
in Cask to Contain the same which ^to him^ he owes and unjustly detains &.a

    Att which day here before the Justices of his Lordships County Court of Somerset
    at deviding Creek Came the af.d John Atkinson by ^Francis Allen^ his attorney af.d and the sherriffe
