159 sort Contented but the same to him to pay or Content hath altogether refused and still doth refuse altho' thereto afterwards to wit the day and year af.d at the County af.d and often since that time by the said William required whereupon the said William says he is the worse ten pounds Currt money of maryland and thereof he brings suit &a Pledges &a J Doe & R Roe A Copy of the ^foregoing^ declaration ^was^ made and sent to be served on the said Benjamin with the writt af.d &.a Att which day here before the Justices of his Lordships County Court of Somerset at deviding Creek Came the af.d William Conner by his attorney af.d and the sherriffe to witt John Henry Gent at the same day here returned that he had taken the af.d Benjamin Henderson whose body hereat this day he had ready to answer the af.d William Conner of the af.d plea as to him it was Commanded and the same sherriffe further returned that he had served the same Benjamin with a Copy of the declaration af.d according to act of assembly in such case made and provided &.a Whereupon Came hereinto Court a Certain Thomas Peal of Somerset County planter in his proper person and undertook for the same Benj.a and assumed upon himselfe (Likewise the Same Benjamin Henderson present here in Court in his proper person assumed upon himselfe) that if it should happen that Judgment in the plea aforesaid should be rendered for the same William Conner against him the same Benjamin or that the Same Benjamin should be therein Convicted that then he the same Benjamin should pay and Satisfie unto the said William the Judgment of the Court thereupon or render his body in Execution of Such Judgm.t to the prison of the Sheriffe of the County afd there to remain untill the same Judgment be fully Satisfyed that he the said Thomas Peal will doe the Same for him &.a whereupon the said Benjamin by William Beckingham his attorney Comes and defends the force and Injury when &a and Saith that he did not assume upon himselfe in manner and form as the aforesaid William Conner above against him hath Complained and thereof he putts himselfe upon the Country and the afd William Conner in Like manner Therefore Immediately Came thereof the Jury before the afd Justices Last mentioned here &a by |
