    Command was given to the sherriffe of Somerset County
that he should take Benjamin Henderson late of Somerset
County planter if he should be found in his bailywick and him
should be found in his bailywick and him should safe keep so that he might have
his body before the Justices of his Lordships County Court of Somerset to be held at
deviding Creek the third tuesday of november Anno Dom one thousand seven hundred
and thirty seven to answer unto W.m Conner of a plea of trespass upon the Case &a

    And hereupon the said William Conner declared against the af.d Benjamin Henderson
in the plea af.d in form following viz.t  Somerset sst  Benjamin Henderson late of Somerset
County planter was attached to answer unto William Conner of a plea of trespass upon
the Case &a      And Whereupon the said William by George Douglas his attorney complains
that whereas the said Benjamin on the twenty second day of october Anno Dom
MDCCXVii at the County af.d within the Jurisdiction of this Court was Indebted to the
said William in the sum of four pounds Currt money of maryland and one three year old
barrow for a young mare by the said William to the said Benjamin at the especial Instance
and request of the said Benjamin before that time sold and delivered as by an account
hereto annexed may appear and so being thereof Indebted on Consideration thereof
afterwards to witt on the day and year last af.d at the County af.d upon himself
did assume and to the said William then and there faithfully did promise that he
the af.d Benjamin the af.d four pounds Currt money of maryland and also the af.d
three year old barrow to the said William when he should be afterwards thereto
required well and faithfully he would pay and Content  Nevertheless the said Benj.a
his promise and assumption af.d in form af.d made nothing regarding but minding
and fraudulently intending the said William in that part craftily and subtilly to
deceive and defraud the af.d four pounds Currt money of maryland and the said the
three year old barrow to the said William hath not paid or him for the same in any
