147 which to him he oweth and unjustly detaineth &.a And Whereupon the same James by Robert Jenckins Henry his attorney saith that whereas the said Richard the twenty first day of June in the year of our Lord God one thousand seven hundred thirty and seven at Somerset County af.d within the Jurisdiction of this Court by his certain writing obligatory which he the said James with the seal of the af.d Richard sealed here into Court brings the date whereof is the same day and year af.d did acknowledge himself to be held and firmly bound unto the said James in the af.d sum of twenty pounds Curr.t money of maryland to be paid unto the said James when the said Richard by him the said James should be afterwards thereunto required yet the same Richard tho' often afterwards theretoto requested the said twenty pounds to the same James hath not rendred but the same to him hitherto to render hath denyed and still doth deny and unjustly detain wherefore the said James saith he is the worse and hath damage to the value of twenty five pounds Curr.t money af.d and thereupon he brings suit &.a Pledges &.a J Doe & R Roe A Copy of the foregoing declaration was made and sent to be served on the def.t with the writt af.d according to act of assembly in such case made and provided &.ca Att which day here before the Justices of his Lordships County Court of Somerset at deviding Creek Came the af.d James Anderson by his attorney af.d and the sherriffe to witt John Henry Gent at the same day here returned that he had taken the af.d Richard Knight whose body hereat this day he had ready to answer unto the af.d James Anderson of the pea as to him it was Commanded and the same sherriff further returned that he had served the same Richard Knight with a Copy of the declaration af.d according to act of assembly in such case made and provided &.a Whereupon a Certain Archibald Stett of Somerset County planter present herein Court in his proper person before the af.d Justices at deviding Creek undertook for the same Richard Knight and assumed upon himselfe (Likewise the said Richard Knight present herein Court in his proper person assumed upon himself) that if it should happen that Judgment in the plea af.d should be rendred for the same James against him the said Richard or that he the said Richard should be therein Convicted that then the said Richard should pay and satisfie unto the said |
