137 with a Certain Sarah Thompson and of her body then and there had then and there had Carnal Knowledge and a bastard Child on the body of her the Same Sarah then and there did begett to the high displeasure of almight God to the Evill Example of all others in such Case offending Contrary to the peace of the said Lord Proprietary that now is his good rule and Government and against the form of the act of assembly in such Case Lately made and provided &c Thereupon it is Commanded the then Sheriffe of Somerset County that he should take the said James Kane late of Somerset County Labourer if he should be found in his bailywick and him should safe keep so that you have his body before the Justices of his Lordships County Court of Somerset to be held at deviding Creek in the same County the third tuesday of August Anno Dom one thousand seven hundred and thirty seven to answer his said Lordship of the fornication af.d whereof she was Indicted &.a Att which day to witt at a Session of the peace held at dividing Creek in the same County before Robert King Gen.t and others his associated Justices of his said Lordship the peace in the County af.d to Conserve and also divers felonys trespasses and other Malefeasances in the same County Committed to here and determine assigned Cometh John Henry Gent sheriffe of the County af.d and Returned that the af.d James Kane was not found in his bailywick Therefore Command was againe to the same sheriffe as before that he should take the af.d James Kane if &.a and him keep &.a so that he might his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of November then next following to answer his said Lordship of the fornication af.d whereof he was Indicted &a Att which day to witt at a Sesession of the peace held at deviding Creek in the same County before Robert King Gen.t and others his associates Justices of his said Lordship the peace in the County af.d to Conserve and also divers felonys trespasses and other Malefeasances in the same County Committed to hear and determine assigned Came the said James Kane ^in his proper person^ and had a hearing of the Indictment afd and saith that he cannot deny but that he is Guilty of the premisses in the Indictment afd specified in manner and form as by the Indictment above against him supposed and the premisses afd Expressly acknowledgeth and is willing to pay his fine for the fact afd &a Whereupon all and Singular the premisses by the Court here seen heard and fully understood &a It is Considered that the afd James Kane pay unto his Lordship for his fine by the Court here upon him Imposed for and by Occasion of the premisses afd whereof in form afd he is Convicted thirty shillings Curr.t money of Maryland (to the use of the County afd) and that the afd James |
