1737 135 permit the same unknown person then and there to have carnal knowledge of her body and to beget then and there a basterd Child on the body of her the same Margaret to the high displeasure of almighty God to the evil example of all others in such case offending contrary to the peace of the said Lord proprietary that now is his good rule and goverment and against the form of the act of assembly in such case ^lately^ made and provided &.a Thereupon it is Commanded the then Sheriff of Somerset County that he Should take the said Margarett Caldwell if she should be found in his bailywick and her should safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of August then next following to answer his said Lordship of the fornication afd whereof she was Indicted &a Att which day to witt at a Session of the peace held at dividing Creek in the Same County before Robert King Gent and others his associated Justices of his said Lordship the peace in the County afd to Conserve and also divers felonys trespasses and other Malefeasances in the same County Committed to hear and determine assigned John Henry Gent sheriffe of the County afd ^and^ Returned that the afd Marg.t Caldwell was not found in his Bailywick Therefore Command was againe to the same Sheriffe as before that he should take the afd Margarett Caldwell if &.a and her keep &.a so that he might have her body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of November then next following to answer his said Lordship of the fornication afd whereof she was Indicted &.a Att which day to witt at a session of the peace held at dividing Creek in the same County before Robert King Gent and others his associates Justices of his said Lordship the peace in the County afd to Conserve and also divers felonys trespasses and other Malefeasances in the same County Committed to hear and determine assigned Came the said Margarett Caldwell & had a hearing of the Indictment afd and Saith that she Cannot gainsay but that she is guilty of the premisses in the Indictment afd Specified above upon her Imposed in manner and form as by the Indictment afd above against her Supposed and is willing to pay her fine for the fact afd &a Wherefore all and Singular the premisses by the Court here seen heard and fully understood It is Considered that the afd Margarett Caldwell pay unto his Lordship the Lord Proprietary for her fine by the Court hereupon her Imposed for and by occasion of the premisses afd whereof in form afd she is Convicted thirty Shillings Curr.t money of Maryland to the use of the County towards defraying of the said County Charge &.a and that the said Margarett Caldwell be taken to satisfie his said Lordship of the fine afd &a Whereupon the said Margarett Caldwell is |
