134 Genll hath transmitted into this Court the account of the estate of William Smith dec.d wherein it is found that there is ball due to the abovesaid orphan the sum of sixty six pounds eight shillings and eleven pence half penny Curr.t money therefore if the above said Magdalene Smith her heirs executors administrators shall and do well and truly pay or Cause to be paid unto the abovesaid orphan the sum of sixty six pounds eight shillings and eleven pence half peny Curr.t money according to act of assembly and the deceaseds will when he shall arrive at full age to receive the same &.a then the above obligation to be void and of none effect otherwise to remain in full force and vertue &.a her Sealed and delivered Magdalin W Smith (+) in the presence of mark Henry Ballard W Gray (+) Isaac Handy James Train (+)
the parish af.d in the County af.d within the Jurisdiction of this Court did commit fornication with a Certain person to the Jurors af.d unknown and did permit the same unknown person then and ^there^ to have carnal knowledge of her body and to beget then and there a bastard child on the body of her the same Jane to the high displeasure of almighty God to the evil example of all others in such case offending contrary to the peace of the said Lord proprietary that now is his good rule and Goverment and against the form of the act of assembly in such case made and provided &.a Testis William Turpin Jun.r On the foregoing Bill of Indictment it was Endorsed as followeth viz.t Billa Vera Samuel Wilson foreman Thereupon it was Commanded the Sheriffe of Somerset County that he Should take the said Jane Andrews Late of Somerset County Spinster if She should be found in his bailywick and her should safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of November ann Dom One thousand Seven hundred and thirty Seven to answer unto his said Lordship of and Concerning her Committing of fornication &.a and that thereof he Should not fail &.a And afterwards to witt the third Tuesday of Novem being the fifteenth day of the Same Month Ann Dom |
