1737 126 name pledges &.c and that the afd William Smashey go thereof without day also it is considered that the afd William Smashey recover against the said Catherine Donelson his 204 damages by occasion of the premisses to Two hundred & Twenty Seven 227 pounds of tobacco to the same William by discretion of the Justices here at his request for his Costs and Charges in that part sustained according to the form of the Statute thereof Lately made and provided by the Court here adjudged &c (enter after ye ret of the Writt as followeth) Whereupon Came hereinto Court a Certain Whittington Johnson late of Somerset County planter in his proper person and under took for the said William Smashey and assumed upon himselfe (Likewise the said William Smashey present herein Court in his proper person assumed upon himselfe) that If it Should happen that Judgm.t in the plea afd should be rendered for the same Catherine Donelson against him the said William Smashey or that he the said William Smashey should be therein Convicted that then he the said William Smashey should pay and Satisfie unto the said Catherine the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the prison of the Sher of the County afd or that he the said Whittington Johnson will doe the same for him &c
Court of Somerset to be held at dividing Creek the third Tuesday of June anno Dom one thousand Seven hundred and Thirty Seven to answer unto Thomas Storow of a plea of trespass upon the Case &.c and that thereof he Should not fail &c Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came the said Thomas Storow by William Beckingham his attorney and the sheriff of the County afd to witt Joseph MccClester Gent at the same day ^here^ returned that he had Taken the body of the same Nathaniel Carrington and him had here ready at the same day to answer unto the afd Thomas Storow of the afd plea as to him it was Commanded And whereupon the afd Nathaniel Carington putts in his place George Douglas Gent attorney at Law against the afd Thomas Storow of the afd plea Thereupon at the request of the parties afd day is given to the same parties before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of August then next following in the State wherein they now are saving to the parties afd &c Att |
