the afd Margarett Causey did not declare against the afd Daniel Rhodes in the plea afd &c

       Therefore she and her pledges of prosecuting being in mercy and that the said Margarett
Causey name pledges &.c  and that the afd Daniel Rhodes goe thereof without day also it is Considered
that the afd Daniel Rhodes recover against the afd Margarett Causey his damages by occasion
264    of the premisses to                                                                     pounds of tobacco to
the Same Daniel by discretion of the Justices here at his request for his Costs and Charges in that part
sustained according to the form of the Statute thereof Lately made and provided adjudged &c

    Command was given to the Sheriffe of Somerset County
that he should take William Smashey late of Somerset County
                               Mariner if he Should be found in his bailywick and him should
Safe keep so that he might have his body before the Justices of his Lordships County
Court of Somerset to be held at dividing Creek the third Tuesday of June Ann Dom one
thousand Seven hundred and thirty Seven to answer unto Catherine Donelson of a
of trespass upon the Case &.c  and that thereof he should not fail &c  (Enter bail p here)

       Att which day here before the Justices of his Lordships County Court of Somerset at dividing
Creek Came the Said Catherine Donelson by Robert Jenckins Henry her attorney and the
Sheriffe of the County afd to witt Joseph MccClester Gent at the Same day here returned that
he had taken the afd William Smashey whose body here at this day he had ready to answer
unto the afd Catherine of the afd plea as to him it was Commanded      And whereupon the
afd William Smashey putts in his place George Douglas Gent attorney at Law against
the afd Catherine of the afd plea         Thereupon at the request of the parties afd day
is given to the Same parties before the Justices of his Lordships County Court of Somerset to be
held at dividing Creek the third Tuesday of August then next following in the State they now
are saving to the parties afd &c            Att which day here before the Justices of his Lordships
County Court of Somerset at dividing Creek Came againe as well the afd Catherine Donelson as
the afd William Smashey by their attorneys afd and because the afd Catherine Donelson did
not declare against the afd William Smashey in the plea afd &c

    Therefore she and her pledges of prosecuting be in mercy and that the said Catherine
