123 did then and there Gently lay his hands on the said Thomas Adams which Gently laying of hands on the said Thomas Adams is the same trespass assault beating and wounding in the Declaration af.d mentioned and this he is ready to verify wherefore he prays Judgm.t if the said Thomas Adams his accon af.d against him to have and maintain ought Whereupon the af.d Thomas Blizard ^prays^ that the af.d Tho.s Adams to the pleas af.d of him the same Thomas ^Blizard^ may reply upon which it is said to the same Thomas Adams by the Court here that he reply to the pleas af.d of the same Thomas ^Blizard^ but the same Thomas ^Adams^ altho' Solemnly Called Cometh not nor to the pleas of the af.d Thomas ^Blizard^ Replyeth nor is his writt af.d against the same Thomas ^Blizard^ further procecuted Therefore it is Considered by the Court here that the af.d Tho.s Adams take nothing by his writt and declaration af.d but that he and his pledges of prosecuting to witt John Doe & Richard Roe be in mercy and that the af.d Thomas 326 Blizard Recover against the af.d Thomas Adams three hundred and Twenty Six 304 pounds of tobacco for his Costs and Charges by him about his defence af.d in that part sustained to the same Thomas Blizard by the Court here according to the form of the statute in such case there lately made and provided adjudged and that the same John have thereof Execution &c
him should safe keep so that he might have his body before the Justices of his Lordship County Court of Somerset to be held at dividing Creek the third tuesday of March Anno Dom one thousand seven hundred and thirty six to answer unto the Right Honourable the Lord proprietary that now is of the province of Maryland of of a plea that he render unto the said Lord proprietary the sum of ten pounds sterling which unto the same Lord proprietary he oweth and unjustly detaineth &c Att which day here came William Goldsborough Gent who for his said Lordship in this part prosecueth and the sheriffe of the County afd returned here ^at the same day^ that he had Taken the afd Charles Dickerson whose body here at this day he had ready to answer unto his said Lordship of the afd |
