by the said Richard Davies against the said Joseph M.ccClester in Somerset County Court
before the Justices of the said Court on the 15.th day of March 1736 the said eighteen shillings
Curr.t money of Maryland and Ninteen hundred and thirty six pounds of tobacco to be
levied of your bodies goods and Chattles lands or tenaments for the use of the said
Richard Davies in case the said Joseph M.ccClester shall not pay and satisfie to the
said Richard Davies in case the said eighteen shillings Curr.t money of Maryland
and Nineteen hundred and thirty six pounds of tobacco so as af.d recovered against him
with the additionall Costs thereon the tenth day of Febrry Next  Acknowledged befo
before us

     The same

    Command was given to the Coroners of Somerset County that they
should take Joseph M.ccClester late of Somerset County Gen.t if he should
be found in their bailywick and him should safe keep so that they might have his body
before the Justices of his Lordships County Court of Somerset to be held at dividing Creek
the third tuesday of August Anno Dom one thousand seven hundred and thirty seven
to satisfie James Hayes of three thousand five hundred and one pounds of tobacco
which to the same James in the same Court before the Justices of His Lordships Justices
at dividing Creek af.d were adjudged for his damages which he had by Occasion of
a Certain promise and assumption to the same Richard by the af.d Joseph
made and not performed whereof he is Convict &c  Att which day here before the
Justices of his Lordships County Court of Somerset at dividing Creek Came the said
James Hayes by William Goldsborough his attorney and the Coroners of Somerset
County af.d to wit Henry Ballard and William Lane Gen.t at the same day here
returned that they had taken the af.d Joseph M.ccClester whose body hereat this da
day they had ready to satisfie &c as af.d they were Commanded &c

You Joseph M.ccClester Francis Porter and Littleton Townsend do Confess
Judgment to James Hayes for the sum of three thousand five hundred and one
pounds of tobacco which sum was recovered by the said James Hayes against
the said Joseph M.ccClester in Somerset County Court before the Justices of the
said Court on the 15.th day of march 1736 the said three thousand five hundred and
one pounds of tobacco to be levied of your bodies goods and Chattles Lands or tenements
for the use of the said James Hayes in case the said Joseph M.ccClester shall not
